No one is stopping people from getting married. Get married to your cat for all i care. The point that states have to make it a law, should show you, there is some contention with it.
As to the divorce rate. Gov't doesn't belong in the Marriage discussion at all, to me.
It certainly doesn't have the ability to fix anything, it only destroys.
No Fault divorce is a stain on our country. The Gov't has no business supporting or destroying marriage.

Religious objections to a secular law don't make any sense. The only connection I see between religion and marriage laws was made by the judge in the Utah decision:
"The recognition of same-sex marriage expands religious freedom because some churches ... desire to perform same-sex (civil) wedding ceremonies but are currently unable to do so."

the first amendment promotes freedom of religion and separation of church and state. You have the right to be against gay people getting married, but it is unconstitutional to get your religious views made law, thanks to the constitution. Just because you don't like that freedom applies to everyone doesn't change the fact that it does.
