The laws are decided by the government. Laws are made by the congress, approved by the president, and determined constitutional by the supreme court.

Actually, that last one about rape came from the Bible. In the Old Testament, the rape law involved this:
1) If the victim is a virgin, the rapist must pay the father of the victim and marry the woman (or really a girl, as marrying age was very young at the time).
or
2) If the victim is married (not a virgin), both the rapist and victim must be executed (often by stoning I believe).

Out of context, Mosaic law was for one set of people that needed to learn through suffering. Due to stubborness.
Here's the thing. Yes, the brain scans show differences. Did their brains become different due to neglect, abuse or a lack of nurturing in childhood? They don't know. Nobody knows. The brain is still developing in childhood. Only adults were tested.
Talk to me when they start doing brain scans on infants and tracking them through their lifetimes to see if they develop psychopathy while focusing on their early environments.

If that's a sin, I want to commit it as much as possible. People who need to look to some deity for moral guidance are morally and psychologically retarded. People who can behave in a moral manner based on the extrapolations they've made from their own sense of empathy and compassion are a step above those who can't.
Then you choose to sin. Many, many do. But there is a Penalty for sin, and it is death.
