In another thread, I noted that I was for the death penalty when it was 100% beyond the shadow of a doubt, no question at all, determined that the person was guilty. The below matches that description.

There is never a "proper use" of the death penalty. Only those with absolute blind trust in government could accept that the death penalty will not be abused. We have already seen the deliberate deception of Congress and the White House over the Affordable Health Care Act. These are the very same people those who support the death penalty are putting absolute trust in that they will not abuse their power and kill innocent Americans.
No government should ever have the authority to kill its own citizens, for any reason, because no government can ever be trusted. With an ever increasing corruption in government, the very last thing any sane individual should want is a corrupt government with the authority to kill its own citizens, because one day it could be you on death row.
Was there an assumption on anyone's part that the OP wanted the death penalty in cases where he'd be UNSURE of the defendant's guilt?

Apparently this defendants guilt was considered "SURE"...good thing he didn't get executed (he was innocent)...the prosecutors conduct (that put this man away for 25 years) was also "SURE"...he should be made to do 25 years too.

I'm never surprised. They've proved time and time again that prosecutors and prosecutorial misconduct is out of control in Texas.

The government isn't the entity responsible for convicting the criminal. That responsibility is given to a jury of peers, unless the criminal has waived their right to trial. In most cases, the jury is also the entity responsible for determining a death penalty sentence. The role of the government in death penalty cases is running the trial, holding the convicted for an insanely long amount of time, and carrying out the sentence.
Quite frankly, I believe that the death penalty process should be sped up substantially. If someone confesses to a crime that is heinous enough for the death penalty, or there is video and/or photographic evidence that they have committed the crime and there is no extenuating circumstance such as mental illness or coercion, the appeals process should be turned into a judicial review to ensure that the trial was performed correctly and the penalty should be carried out within a year.
We currently spend millions if not billions on housing death row inmates that have been convicted beyond a reasonable doubt and additional billions on retrying them through an appeals process that has become a game for the inmates and a great source of income for trial lawyers.
