Sounds like his parents could carry some of the blame for their Minor Son being out this late possibly assaulting a family when they are asleep.

Wrong, courts have ruled that 16 year olds have the authority to give consent to enter homes

I'm atheist and a Dad, and I would permit my kids to entertain a significant other in their room, if it was legally permissible (as in this case it would be) and if they were safe and responsible.

This argument will hold no legal water. If this were true then I must have committed breaking and entering hundreds of times as a kid, as I went over might friends houses all the time without explicit written consent of their parents. I'm just glad one of their parents never came home and shot me in the head at the very moment they spotted me.

Had he known the kid had no gun, I doubt he would have shot, but the kid made a fatal mistake after being warned not to move, he reached for something, I may have shot also.

Neither will you, but it doesn't matter in this case, this is the south, where justice = the guy with the quickest draw.

I see the anti gun nuts are out in force here.

1) Daughter lied about not knowing intruder (similar to cases where daughter has sex with man, is found out and later claims rape) - I personally think she should be charged with something here

2) Father @ 2am witnesses stranger in daughters bed who does or does not move - In Texas the self defense laws are much more lenient and I am pretty sure the grand jury will not indict

3) Personal civil liability - if any exists here it lies squarely on the daughter

An enraged father with a gun asks his teen daughter if she snuck in her boyfriend and had sex with him, what do you expect her to say????

People live in fantasy land, the girl was obviously afraid, and for good reason.

Actually he could've been 18 or a young 19 and still been in the clear according to the TX law that was cited earlier.
