There can be contracts of commitment, enforceable by the courts.
Anyone can call themselves married, but the word itself would have no legal meaning.

I thought that until it became clear to me that the word "marriage" is important, even to gay people.
Beyond that, you seem to be splitting hairs. Under your proposal is the government involved or not?
