The mayor of Warren, Michigan is going to have a problem winning this lawsuit. Just like in Oklahoma City where the Church of Satan wants to erect a monument because a display of the Ten Commandments were allowed to be displayed, he cannot discriminate because of his whims.
He also needs to educate himself before he makes idiotic statements. The Nazis were an avowed Christian organization from their conception, and the kkk used to be called the "Christian Knights of the Ku Klux Klan". I'll bet he approves their application next year.
The problem with athiests is that they dont promote their beliefs( or lack thereof) they simply want to stop others from having religous beliefs.
