Cinco De Mayo is not even a national holiday in Mexico, and did not become popular in the US until the 1980s when beer companies made it into a holiday for drinking their beer.

But now it has become illegal to wear a t-shirt with the US flag on Cinco de Mayo day because to do so is a threat, and might incite people to violence.

Are there also laws which ban people from wearing flags of other nations on the 4th of July, or wearing clothing signifying another religion on Dec 25th? Or is it just quick to anger Mexicans, athiests and Muslims that Americans need to bend over and grab the ankles for?

9th Circuit Affirms American Flag Shirt Cinco De Mayo Ruling

The full slate of Ninth Circuit judges has thus agreed with a lower district court and with a trio of appellate judges that officials at Live Oak High School in Morgan Hill, Calif. could censor students who wanted to wear flag-emblazoned shirts.

1. It's not illegal.

2. The ruling only applies to students of a high school in California.

I'm no lawyer, but I think the decision would be overturned if appealed. I cannot see any way that this is not unconstitutional.

I can understand some basis for a school mandating certain dress codes or appropriate attire, but not for this reason. If it's OK to celebrate Cinco De Mayo on school grounds, then it's OK to celebrate America on school grounds.

If doing so would spark violence, then Mexican students need to learn some tolerance in their new country.

I guess this is repression in America. If you don't get everything that you want all the time it's going to be the next holocaust.

It is the decision of a single high school in California about dress code for a single day in a year. [MOD CUT/rude]

Well, first of all the flag should never be worn as apparel, see U.S Code Title 4, Chapter 1, Section 8, Paragraph D.

Flag Code

So?

This applies to a single high school. High schools already have dress codes, some of which are already stupid. Adding one more stupid rule is hardly the end of the world. If you don't like it, don't affiliate with that school. Don't teach there; don't send your kids there; whatever.

A single violation of our rights is too much.

I totally agree. This is how they are eroded, little by little, while it all seems trivial and insignificant - until one day people wake up and wonder what happened...

No flags should be allowed to be worn on apparel at any public school.

American Flags should be the only ones allowed at any American Public School to be flown in any place of honor.
