Of course Christians are retarded for being nice and forgiving everybody, no wonder why they are the victims because people know nothing will happen when you do any type of hate crime against Christianity.
Maybe the above is sarcasm, but Christians are not always nice and do not forgive everybody. Neither Jesus nor God forgave everybody.

Well if he comes to believe in Jesus he will ask for forgiveness and be absolved. If he doesn't and on the off chance Jesus does end up being mankind's saviour does it matter what he did? I'm sure a lifelong denial of god will do him in anyway.

Doesn't matter. If he is strong and muture enough damaging and vandalizing private property, especially something considered holy for most Americans, then he is muture enough being punished!
If a statue of Jesus is "holy", that would be idolatry that's not in line with Christianity. If I draw a stick figure of Jesus and then crumpled it up and threw it out, should I face years in prison, too?
