Appeal it to the USCOA, and ultimately to the SCOTUS, and watch that decision be overturned.

The caveat is that is illegal to wear the US flag in any way, anyway. It is never enforced, but is a way out of making a rational decision to appease the political correctness anal crowd.
Nope it is just a school system attempting to be fair to all and avoid trouble and by not allowing either they did just that, Strange it is not those with a Mexican heritage that are whining and by the way the SCF will not end up over turning the 9th Circuit, there was not violation of any rights.

These authoritarian totalitarian administrators are trying to keep kids from celebrating our/their heritage if it falls on a foreign holiday. How is wearing a US flag keeping the Mexicans from celebrating?

It's insanity on display!

Like I said, it is illegal to wear the flag, or represent the flag in any way other than as a flag. All those flag pins are actually illegal, if one wished to be a stickler for the law.

You can burn it, but you can't wear it.

Why would the Supreme Court ever take this case on appeal. The law is long, long settled, and the court's application of the law (well, both courts' applications) was 100% spot on.

I can't see any court in the US ruling differently, and if for some strange reason the SC took it up, it would be a 9-0 affirmation.

And what is the USCOA? The 9th Circuit is directly below the Supreme Court - that's the only other place this case could go.

If you say so, tell it to everyone serving in the Military and wearing a law enforcement uniform. I have several patches and pins and even have a shirt using the symbols of the flag, not to mention the ones I used to fly 365, now replaced by my Texas flag.

Wow. A bunch a ballywhoo over whether it's okay to wear American flag 'T-shirts'..
It has always been inappropriate to wear any clothing that displays the image of our flag. Thank-you to all the posters that have been trying to ILLUSTRATE that fact.

Flag Code-
Quote:
"The flag should never be used for advertising purposes in any manner whatsoever. It should not be embroidered on such articles as cushions or handkerchiefs and the like, printed or otherwise impressed on paper napkins or boxes or anything that is designed for temporary use and discard. Advertising signs should not be fastened to a staff or halyard from which the flag is flown."
It is with permission that organizations (such as the BSA) can wear an embroidered patch of the flag on their class A uniforms. We spend a lot of time teaching our boys how to properly display flags at ceremonies as color guards. Proper positioning, displaying the flag while carrying or holding- we even have a dedicated flag retirement ceremony.

People- YOU SHOULD NOT WEAR A T-SHIRT WITH THE IMAGE OF THE FLAG. The 9th circuit should have just simply followed (applied) the code that is in effect. The school should have simply applied the code in effect.

My God... Americans don't seem to take any responsibility in understanding civic due diligence.

It is not a foreign holiday. It is not generally celebrated in Mexico, except maybe by Americans vacationing in Mexico.

Still, Cinco de Mayo is about a war that Mexico fought and won. It has nothing to do with "our" history.

Ban the Mexican flag, NOT our flag. If a bunch of la raza types get upset, they can leave the US.

What if they are not "la raza" types, although I'm not really clear what that is suppose to mean.
Shouldn't all Americans have the right to celebrate their cultural heritage without being harassed by so called patriots hiding behind the American flag.
