Again, if a question asked by a clerk "is this a GAY marriage?" is the only thing stopping this woman from getting her license then there is a problem.
I think even HappyTexan would agree that's not exactly a security measure.
The problem seems to be that the individuals issuing licenses want this to be a way they can show their displeasure. If they don't have a problem with "gay marriage" they won't even ask the question (why should they??? IS THAT A LAW IN TX TO ASK????) but if they DO have a problem with "gay marriage"....see where this goes dontcha.
That still does not explain how Texas can invalidate a Social Security Card.
Even considering RealID, how is the California driver's licence a invalid ID? There is nothing in the RealID law that says marriage is a disqualifier. ReadID was to keep terrorists from attaining a ID.
Show the federal statute which allows the State of Texas to invalidate a Social Security card based on Same Sex marriage.
Like other states Texas only accepts certain documents and an SS card is not one of them.
No it doesn't. This is no different than how interracial marriage was treated by states in the 60's.
It took the Supreme Court to make a ruling over all the states for interracial marriage to be legally valid in all states. That is what will need to happen with gay marriage.

This isn't true. It's not that they "cannot" - it's that DPS has decided to not.
The certificate serves two purposes- it serves as proof of a California marriage, and it serves as proof of a legal name change. Texas DPS could most certainly accept the document as proof of a legal name change without recognizing the marriage.
Colorado does this (Colorado has an identical gay marriage ban to Texas) - Colorado takes same-sex marriage certificates as proof of legal name change without recognizing the marriage. When the Federal Government had a ban on gay marriages, it accepted same-sex marriage certificate as documentation of legal name change for getting a passport without recognizing the marriage.
