Robin Garrison, an off-duty 42-year-old firefighter, was walking in Berliner Park in Columbus, Ohio, in May when he saw a woman sunbathing topless under a tree.

I don't see how it could be considered entrapment since sunbathing topless is legal there.

How about the part where it's the topless undercover cop who ASKS to see the man's penis? Think that might be going a bit far? Was it in this man's mind to commit the crime of exposing one's penis in a public place before the police officer PUT that thought there?

Sicko? The man was an off-duty firefighter out on his regular walk in the park. According to the article, this wonderful program in which police try their best to pressure passers-by into committing petty crimes has previously nabbed such typical dangers to society as doctors, state employees, and highway troopers. Thank God the citizens of Columbus are being protected from that lot...

I know a bit about the story and your presumption is WRONG... the topless lady is NOT an undercover cop. It is within Columbus law that ladies can go topless. She was expressing that right for a couple of weeks. That firefighter you talking about made SEVERAL trips to the park to see that lady, cause she been there several times minding her own business. Cops figured they would bust her for doing something illegal and kept an eye on her but she wouldn't do anything illegal so they couldn't bust her. She did however asked to see his penis, that much is true... he showed and that IS against the law... he should of known better.. by the way, he is also married with kids.. don't let the news try to blindside you.. the truth always helps..

I don't know how the law views it but it seems to me that when she put her foot on his shoulder the game changed.

The game did change... he should of said, "lets go back to your place"... instead he violated the law. I am sure she would of went with him... but he took a different approach and got caught...

I am not sure how I would come down here. On one hand, he should not have done it but on the other she had no business soliciting him to do it. In fact it is also a crime to solicit people or "egg on" people to commit a crime that they otherwise would not have done. This is different than setting up a police lady on the street and waiting for a passerby to solicit her or setting up a phony drug dealer on the corner and passively wating for people to come and try to buy dope. This is actively going to another person and engaging to encourage the commission of a crime which itself is a crime.

But the question remains: In going from a passive to an active role did she violate the law?

I hardly behave her behavior is going to do anything to get the real perverts off the street, the pedophiles and those who would expose themselves with no enticement. I'm all for getting the predators off the street, I just don't believe that category includes normal hetero males who stupidly allow a rush of hormones to influence their judgement.
