It just seems likes a very convenient (and impossible to disprove if everyone sticks to the story) justification for an otherwise unconstitutional search.
If you aren't offering force, then a police officer shouldn't pepper spray you. While I do agree that being a wiseacre with the police isn't a smart thing, if that is all you're doing, pepper spray is extreme. If you aren't making death threats or the like, then the officer should maintain some control. This cop's reaction was a case of "I don't like the way this person is talking so I will knock him out". If a civilian did that, said person would be charged with assault and battery.

Are you speaking for LEO or the kid? Cops are not your friends and will lie to you or on police reports. Why do they always separate a group of people into individuals when questioning them? To purposefully trip them up with some inane factoid, lie and tell the individuals one or the other rolled over on them or other thing to get you to say something stupid, even if you have nothing to hide because nothing is amiss. The LEO merely want a collar so they have some paperwork to hand in. An empty handed cop looks like a lazy cop.
If the police entered my home by mistake, I would be pissed off, but I would still do what they said and cooperate in order to protect myself and my family. It should be easy enough to straighten things out. Talking back to police or acting threatening in anyway would not be on my "to do" list.
Who knows how true that is anyway. it wouldn't be the first time police lied to cover up their **** ups.
Don't need one for a crime/suspected crime in progress.
Sheriffs have much different legal abilities than do police.
One is elected and one is hired.
