And yet many states have passed legislation barring the admission of new evidence after set periods of time.

Every day innocent men and women are convicted of crimes. While many criminals get away. Nobody's perfect, this includes judges, juries, and everyone else involved.

It is very unfortunate for these individuals, but it is a harsh system that has its flaws, i'm sure there will be many more instances of this.

Any evidence that can prove someones guilt or innocence should be allowed.

Prosecutors should be punished for "sitting" on evidence that can prove someones innocence.

Judges should be willing at any time to reconsider a case where there is new or existing evidence that wasn't presented the first time.

Any innocent person should not sit 1 day in jail because of a lazy system.

The old saying about "laws and sausage" applies equally to the criminal justice system.
It is an epic failure. The only reason that there isn't an armed revolt against it is because it doesn't effect enough white people, thus, we're able to believe about it what we're told to believe when in reality, it doesn't operate as we think. It isn't as "fair" as we would like to believe.
The conviction of Martha Stewart or about 80% of the firearm regulation cases made by the BATF are classic examples of this.
