A Federal Judge in South Dakota has ruled the state's ban violates the Constitution. She has stayed her decision pending appeal. South Dakota's AG has stated he will appeal to the 8th Circuit. Missouri and Arkansas have also appealed the overturning of the bans they had in place to the 8th Circuit. Chances are the three cases are merged into one.
