Wow, I am shocked that the Army was allowed to disobey King Barack to this extent. I felt for sure that the present Admin would have this whole case swept under the rug and quietly give Bergdahl a less than honorable discharge.
Bergdahl is in "custody." He is assigned to Ft. Sam Houston. The investigation into the case is complete as reported recently, so an Article 32 hearing should be happening in the near future. It isn't going to be a tough case to prosecute. Bergdahl communicated his intentions via notes left at the outpost in Afghanistan and via communication with friends and family, both of which have already been widely reported.
I know he's in custody. The point is that you can't charge him with desertion unless you suspect somehow that he deserted. And you don't know he deserted unless you can question him to ascertain whether or not he did. And you certainly can't call him a deserter unless he's been convicted of desertion.
And Bergdahl has to be in U.S. custody to make the charge stick.
Why should is be an embarrassment? Bergdahl is a US citizen, and US brings back her servicemen. Weather or not he will be charged with something later is not relevant to the fact. Israel traded 1000 Palestinian prisoners for one of their own, and they would have done so even if the soldier in question had broken a rule.
You do know that The maximum punishment for desertion during a time of war is death right? They should have left him to the Taliban.
There are many ways to bring back a comrade without making a five for one trade.
I would not call a deserter a "fallen comrade". And when somebody goes over to the other side, I'm not sure he is a comrade at all.
The fab five had never been charged or prosecuted in a civil or military court, despite a decade of imprisonment. They were scheduled to be released in accordance with international laws/ treaties that govern this type of stuff.
How is this the Army going against the CINC? The Uniform Code of Military Justice defines what constitutes desertion. The investigation and results of the investigation have nothing to do with the President. Granted, Obama did trade 5 prisoners for Bergdahl, but that has no impact on the Army's findings regarding his status as a deserter.

The "conservatives" around here were outraged that we got back a POW because he was probably a deserter, and now they're outraged because he's being charged with desertion? Didn't the Pentagon and White House say the entire time that there was going to be a full investigation? So, they did what they said they were going to do; the guy will get his day in (military) court but yet there's still outrage.... Well, okay then.

There have been thousands of desertions since 2000 probably a few court martials, not sure what the president has to do with desertions. I have to wonder what same people that thought we should have left him would be saying if he was executed.
Regardless, it's blame Obama.
