The majority voted to legalize recreational cannibis. That's called democracy, but it seems the US congress has a hard

LOL! And there it is folks! Your so-called "small government" republicans at work again! While I did not vote for either party in the mid-terms I was hopeful that when the GOP took control of congress they would actually practice what they preach in being the party of "small government." I didn't actually believe they would (and right here is further proof) but I was hopeful. Party of small government my a**! Only when it's convenient to them! They're no better than the damn democrats in terms of expanding the government, wasting our tax money, and spending like drunken sailors! I hope everyone of these idiots on both sides of the aisle gets voted out, and we the people wake the HELL up and vote for candidates that work for we the people, will adhere to the Constitution, are champions of individual liberties, instead of the cronyism BS we have in DC now! Gay marriage is a constitutional issue. Marijuana is not.
I thumb through my copy of the Constitution, and I don't see "gay marriage" mentioned. But maybe you're right. It could come under the First Amendment, or perhaps the tenth.
But the constitution is a dead letter anyway. We long ago killed the first Amendment during the Wilson admin (Schenk case), the Second Amendment under FDR(1934 NFA). The Fourth Amendment has been null and void for a long time, but was officially put out of its misery with the Patriot Act. The Fifth Amendment was jettisoned with the Kelo ruling. And so on.
