This is exactly what FIRE does... takes on university free speech cases.

Why don't you ask him?
Do you believe the Black Power fist on campus student should be expelled?

While they may not be arrested they can be expelled without challenge by violating student conducts. Happens all the time, if you get got cheating, lying, etc.

I'm dissapointed Donald Trump hasn't come to the defense of these poor kids who didn't have the right to be racist in the privacy of their own confines.

Kudos to the student who videoed and leaked it.

Cheating and lying are not Constitutional rights.

The worst part of all of this is that these students will likely get a settlement from the university for acting in haste. The students will end up paying the racists with increased tuition.

Two have been expelled - I'm sure there's an online defense fund starting up for them - feel free to find it and contribute.

FIRE - Defending individual rights in higher education.

So... is Boren also expelling the Black Power fist student? That equally causes a so-called "hostile learning environment" given Shabazz's invokement of Black Power after his "kill Whites" public statement, and even MORE so as the Black Power fist was displayed on campus during Boren's statement.
FIRE is an idealistic organization. While they seek to reimbursed their legal costs, have they sought any large settlements on behalf of the students they represent? If not, then part of the motivation for going to court is removed.

And again, the Black Power fist is not considered threatening by many Americans. No matter how many times you tediously cite Shabazz.

Prohibited Conduct
These definitions include, but are not limited to, the following:
1. Abusive conduct: Unwelcome conduct that is sufficiently severe and pervasive that it alters the conditions of education or employment and creates an environment that a reasonable person would find intimidating, harassing or humiliating. These circumstances could include the frequency of the conduct, its severity, and whether it is threatening or humiliating. This includes physically abusing a person or holding a person against his or her will. Simple teasing, offhanded comments and isolated incidents (unless extremely serious) will not amount to abusive conduct.

On another note, you can and will be fired from a government job if you were singing a racist song while participating in a government facilitated/endorsed/sponsored function.

Bingo. Boren's knee-jerk reaction will cost everyone but him. He's an incompetent idiot.
