The BSA does not receive any funding from the government. At most they were permitted to organize events on federal land, just as we can still do today, as can any organization.

The LGBT community targeted corporate sponsors and other organizations.

Marriage is not a right. Government has no businesses deciding on it. The problem began when government got involved.

The thing about FREEDOM is that it allows people to do things that you don't approve of. Conservatives love the word "freedom"... but they hate the concept.

Except maybe wedding planners and all things associated with weddings. Their bottom lines potentially just got a lot fatter. There are going to be some fabulous weddings in the future.

Actually the BSA did receive quite a lot of indirect subsidies from the government- most commonly free use of Federal and state park facilities, school facilities, etc. Thankfully most of that has been withdrawn except in some backwater states.

As for targeting corporate sponsors and other organizations... what is it about FREEDOM OF SPEECH that you don't understand?

"(T)he Court has long held the right to marry is protected by the Constitution." We have the obvious cases where this has been upheld, such as Loving v. Virginia and Turner v. Safley. We have cases like Lawrence v. Texas, in which the right of gay people to be intimiately together superceded certain bigoted laws. A whole host of family-related rights have come to us from the 14th Amendment (and the First Amendment, which, Justice Kennedy has pointed out before, could have been the driving force behind Pierce v. Society of Sisters, which was the landmark case that gave us a lot of great things). The special rights associated with marriage came into play in Griswold v. Connecticut, too.

Also, we can't forget Maynard v. Hill, which established that marriage creates rights and duties that go beyond a civil contract. Marriage is central to the social order, and the Court has absolutely been justified in making rulings on it.

It should be obvious that there are many, many laws regarding marriage. Equal protection and due process, two very important principles in the Constitution, therefore (now officially) imply that the Constitution says something direct about marriage.

Oh, and before someone tries to hide behind "states' rights," the ridiculous idea that states can ignore the Constitution is not really taken seriously by actual legal minds, as has been established by many, many decisions. Deal with the way this country is set up, or go start your own country.

Why did the LGBT community want to destroy an organization just because they didn't agree with their moral standards? They want their freedom but they hate the concept that other people are free to feel differently about them.

It's a two way street.
