Under Florida Law - she was guilty of 3 counts of Assault and that's exactly what she pled guilty of in her recent "plea deal". That's the same "deal" she turned down when the event occurred.
She originally planned on using the "Stand Your Ground" Law as her defense (which Zimmerman did NOT use). She couldn't do that, nor could she use "Self Defense". She was in his house, she left the house and went to her car to get a gun, then she went back into the house and fired the gun toward her husband and his 2 sons (lucky she is a bad shot). The Jury deliberated 12 minutes - that was all based on "she left the house" (no Stand your Ground OR Self Defense).
She got 20 years because it was a Mandatory Sentence - a sentence that was way too harsh in this set of circumstances, BUT the Judge had to follow the Law.
Her husband had a long history of abuse, she had a restraining order against him (did I mention she went to his house?) She also had a history of "battery" against her husband. Neither one of these people is very bright when you look at the entire situation. A similar case happened against a White Man with a similar result a couple of years back. None of this had ANY similarity to the Zimmerman case at all.
A judge threw out Alexander's "stand your ground" self-defense claim, noting that she could have run out of the house to escape her husband but instead got the gun and went back inside. Alexander rejected a plea deal that would have resulted in a three-year prison sentence and chose to go to trial. A jury deliberated 12 minutes before convicting her. |Huffington Post
Marissa Alexander rolled the dice and lost .... she is darn lucky they gave her another roll.
I'm betting she will be more careful in the future - she won't have a "gun problem" anymore.
Sounds like the Florida Legislature needs to do some work on their "Mandatory Sentence" Laws.
