What's really messed up is businesses can and have been fined for asking for proof that a worker can legally work since it's discriminating based on national origin. I'm still trying to figure that one out.
That's not exactly right, it seems that the issue was not demanding proof of eligibility but rather Abercrombie not demanding proof of eligibility from others. Which is interesting because it has been my understanding that everyone has to show proof of eligibility.

On June 25, Abercrombie & Fitch settled an immigration discrimination charge by agreeing to pay over $158,000 and submit to two years of federal monitoring. The charge against the clothing retailer, which has several locations in California, was filed by a woman who claims that she was required to present a green card to prove that she was eligible for employment, although similar proof was not required by applicants who were U.S. citizens.
The company's request of the plaintiff reportedly violated the U.S. Immigration and Nationality Act. Although the company did not admit to discriminating against the plaintiff based on her immigration status, the company agreed to pay the woman $3,661 for back pay plus interest. A $153,932 fund was also set up to compensate other people who might have been similarly discriminated against. The company also agreed to pay a $1,100 civil fine for the violation.
Now it's time for them to go after all those Indians who work in IT and blatantly discriminate against non-Indians. It's long past time for that to happen!
It is federal law that you cannot discriminate like that when hiring someone. The law is based upon the historical practice in our country of not hiring people based on color, religion, or ethnicity. If you deny someone qualified to do a job based solely on the fact that he/she is not "Indian" then that is an easy case of discrimination.
I work for a multinational company for a number of years. We had a lot of high turnover rate and huge use of interns. Bit of a running joke that if an Indian ever gets promoted to manager the entire department he runs will be Indian within a year. happened 3 times.
That's because they are hired from those countries through the Walt Disney World International Program.

I notice at EPCOT the folks working customer facing positions at the Mexican, Norwegian and Moroccan restaurants tended to look like what I expect Mexicans, Norwegians and Moroccans respectively to look like.
Yeah, but they tried to pass off Americans as Canadians at the Canada pavilion. You didn't fool me, Disney!

Indian, Mexican, Chinese, Martian, Saturnian or any other ethnic business be able to hire the people it wants to staff to give its business the atmosphere it wants.
