The University may have rules unto itself. The university does not have the authority to put anyone in jail however they can expell a student if they feel the behavior warrants expulsion.
It is not a court of law.
But it is still subject to both the State and US Constitutions (in the case of public universities and colleges).
The State -- acting through the university -- violated his rights.
