In that part of rural eastern Kentucky (coal mining country) to have a job paying $80,000 a year is like heaven. She lives like royalty. Keep in mind that the average annual income in Rowan County, KY is just $35,000 and almost 1/3 of the population lives under the Federal poverty rate. Ever see the TV show "Justified"? It's set in the same area ...


If I was her I would be greedy too, but the law is the law and we must follow it even if we disagree. Our nation's highest court has issued it's ruling and we must respect it.

She is still playing games, the judge should send her back to jail.

Lawyers for the ACLU have requested that the judge order Davis to resume issuing normal marriage certificates instead of the modified ones she has replaced them with. The replacement licenses say they were issued not under the authority of the county clerk, but "pursuant to federal court order." And if she refuses, they are asking that the judge place her office in receivership for the purposes of issuing marriage licenses.

"The adulterated marriage licenses received by Rowan County couples will effectively feature a stamp of animus against the LGBT community, signaling that, in Rowan County, the government's position is that LGBT couples are second-class citizens unworthy of official recognition and authorization of their marriage licenses but for this Court's intervention and Order," the lawyers for the couples wrote in a court filing."

Are the licenses she is issuing valid, if so, she is complying with the court order. Does the federal government have the authority to dictate what needs to be on a state marriage license?

There's a question of whether or not they're valid. She altered the licenses to declare that they were not being issued by the county, but rather "pursuant to federal court order." Then she ordered her deputy to issue the licenses in his capacity as a notary public rather than a deputy clerk of the Rowan County Clerk's Office.

She was told not to interfere in any way with the issuance of licenses, and by altering them to suit her own purposes, she has violated that order. She doesn't get to make her own rules.

If the state of Kentucky considers the licenses valid, then she is complying with the court order. If there is a question about whether or the the licenses are valid, then this bounces back to the state of Kentucky to make that determination. Either way, the federal government isn't involved at this point.

But if the judge determines her actions violate his court order, then the federal government is involved.

She is the kind I generally want to defend.....someone who stands on principle no matter what even if I disagree with them. In this case I can't.

She initially had a valid argument. When she was hired she was not required to give out license to gay couples and doing so would be against her religious beliefs.

The courts gave her that leeway. She did not have to give them out.....she just couldn't stop others from doing so. Up to this point we are in great shape. She does have rights where her religious beliefs are concerned. What she does not have is the right to force those beliefs onto others.

I disagreed with initially jailing her but no longer. She should be back in jail, charged and tried.
