Injustices happen all of the time. A person may be indicted because of mistaken identity, malicious prosecution, or a politically motivated issue. This becomes more probable in an increasingly polarized political climate.
Recently, there is a new wrinkle. The Supreme Court has affirmed the right of the State to freeze assets before a conviction is rendered.
Here is the text of Monday's Supreme Court decision:
Bloomberg Law - Document - Kaley v. United States, 134 S. Ct. 1090, 188 L. Ed. 2d 46, 82 U.S.L.W. 4110 (2014), Court Opinion
What can happen here is that assets unrelated to an allegation can be frozen if there is an expectation that a conviction might result in their forfeiture. This could result in your inability to afford decent legal talent.
My question to all of you is this: Are family trusts an effective barrier to forfeitures of this type?
