There's already processes in place that law enforcement can detain you and involuntarily commit you to a mental institution if there is evidence that you may be a danger to others around you. Look up mental health warrants.

As a law abiding gun owner in California this law really seems very unfair. I'm starting to really dislike living here. While it has the feel good "we're doing something to stop gun violence" it really doesn't stop anything, BUT it does allow for retaliation and a easier way for control and confiscation. It's just easy to manipulate this law. There is way too much Big Brother in this law. It's just another feel good gun law that in the big picture does nothing to curb gun violence

But this law doesn't lock you up for being mentally ill, or for commiting a crime. It confiscates your legal property withouta law being violated. I have a serious problem with that.

oh geezus..cops have been removing guns from people involved in domestic violence for safekeeping for at least the last 30 years, not even the NRA has been willing to challenge that. This simply provides a procedure for extending that safekeeping to 21 days upon the ex parte order of a Judge. It can only be extended past 21 days upon application to the court with evidence that there is still a potential for violence in the home and the party from whom the guns were taken can appear at that hearing and object.

How about this...think twice before you threaten or inflict violence on your spouse or significant other and you won't ever have to worry your pretty little head about this

Read the law and you might reconsider your position. In California cops have been removing guns for safekeeping from the scene of a violent domestic violence for decades, and they have been returning them. This extends that 72 hours safekeeping period IF and ONLY if a judge thinks there is still a potential for violence to occur in the household
