Big difference between not being classified at the time they were sent versus not having the classification on the messages, even though they were classified.
Tough to believe that something would be determined to be top secret after the fact.
Frankly, I doubt it.
I think the classification was somehow removed when transferred to her private account.
By every indication, that clearly appears to be what happened here.
The Obama administration has confirmed for the first time that Hillary stored 'top secret' documents on her unsecured personal server.
As has also been well documented, former high ranking Obama officials such as Secretary of Defense Robert Gates have publicly stated that the Chinese and the Russians almost assuredly hacked that server and whatever information was on it.
This is the Obama administration confirming this. If this woman is not indicted for her crimes, then the only explanation will be that Barack Obama and his administration are thoroughly corrupt.
There is no doubt now who the mole was leaking all that top classified intel to the Chinese.

Clinton and her top aides had access to a Pentagon-run classified network that goes up to the Secret level, as well as a separate system used for Top Secret communications.
The two systems — the Secret Internet Protocol Router Network (SIPRNet) and the Joint Worldwide Intelligence Communications System (JWICS) — are not connected to the unclassified system, known as the Non-Classified Internet Protocol Router Network (NIPRNet). You cannot email from one system to the other, though you can use NIPRNet to send *emails outside the government.
And yet ....... some of these Top Secret & S.A.P. emails popped up on Clinton devices (which were NOT issued by the US State Department) and stored on her Private server. Somebody copied the information and sent it to her, so YES - they were not "marked classified". The FBI knows exactly who did that, because a record is kept of every use, who used it and what they looked at. They are still building the case and it will be bullet proof when done. The Rubber is going to hit the Road for Loretta Lynch.

1. The FBI found cloud storage of Clinton's emails in October.
2. The FBI is no longer working with the State Department on classification - the stonewalling was never ending -- they are now working with Intelligence.
3. The FBI has refused to divulge to either the DOJ or TeamObama anything about their investigation.
4. The 22 emails that both the State Department & TeamObama are now saying was S.A.P. and can never be revealed is not the only emails they are withholding. TeamObama is withholding and refusing to release ANY emails between his Team & the Clinton Camp.
5. They have found emails that show that Patrick Kennedy (the guy who really runs the State Department) knew about the Clinton Server & tried to get her attorney to destroy the backup to the un-deleted emails. The Attorney refused to do that.
