NO ONE has claimed that Obama CANNOT nominate.

If it it is OK to take this long for a lower court, it makes sense to take LONGER for someone as important as the SUPREME Court.

So, let Obama nominate and the Senate can take as much time as they want to vote in committee.

You are so right. My view is that the Democrats see the process as something that is necessary, and often a philosophical fight, but something that must go forward because it is a duty. Yes, they reject some because they are too conservative, but just as many or more are approved under D consideration.

Meanwhile, the Republicans say from the start that they WILL REFUSE any nominee - simply because. For them, it is more about a political strategy of "[NOT] fair play" and "payback" even before a name is mentioned. Childish and irresponsible.

But really, look at the list you posted...

1. ROBERT BORK -- Rejected by Dems.
2. ALEXANDER WOLCOTT - Who? Oh yea, prehistoric. Widely rejected, not just by dems.
3. ROGER TANEY - Democrat rejected by the Whigs
4. EBENEZER HOAR - Rejected by Pubs
5 & 6. WHEELER HAZARD PECKHAM AND WILLIAM B. HORNBLOWER - Rejected by a single (D) senator
7. HARRIET MIERS -- So unqualified she couldn't even get out of conference - rejected by Herself.
8. DOUGLAS GINSBURG - Rejected by a single (R) senator.

This list does not support you thesis.

Oh, great, so you found one example from thirteen years ago. Still not actually relevant, since the Democrats were obstructing one specific nominee because they felt his views were too extreme.

To remind you, in this case, the GOP has already announced that they will not confirm or give a hearing to any nominee, even if Obama nominates one of Scalia's kids.
