If it were made illegal, which I do not think it should be, the punishment should be a fine in what would be most cases. In a scenario where the baby is nearly fully developed, I can see a harsher punishment, but I'm not one to think throwing people in jail for half a decade is really a solution to anything, which is a pretty exceptional view for an American to hold. After the third trimester, I'd say it should be a case by case basis but I don't think I would recommend anything more than a year tops.
If there are no legal facilities in range because conservatives trumped up necessary regulations in order to prevent an otherwise legal act... NOTHING.
So the scenario is abortion is illegal after 20 weeks in a state. A woman 36 weeks pregnant decides she wants to abort and pays a doctor to do it. They get caught, no evidence issues. Should the woman be punished?

36 weeks is 9 months. The punishment should be the same as murdering a baby after birth. In many States pre-meditated murder carries the death penalty.

How about tossing in all the gangs and drug dealers as well to get taken care of?

so we choose the crimes that are punishable by personal preference? WOW ? first this question was vague, in fact was a trick question, because there were insufficient facts introduced - What is the morning after pill?? but it is legal--now I do NOT know all the state laws - maybe some place it is not-- but that is an abortion if you take it in a state that it is NOT legal-- so then what?
if something is illegal --all got to court its the law period- this is a useless debate with people interjecting their thoughts - again NO relative facts

I agree if it is illegal than the courts should decide what the punishment is but why all the talk about aborts as there are ways to prevent any aborts to be needed unless it is for medical reasons.
Any woman who gets raped knows she was raped and should get the morning after pill to avoid a pregnancy.
There is a pill that prevents pregnancies and on the market for decades and if it fails to work than the talk about a different option should be allowed as well if a mother is at risk or the fetus has a birth defect...jmo...for all other things there should life and not arts as it is not just for the heck of it to rib some legs and arms off a fetus!
Doctors who commit an abortus should be punished as if there are no doctors who break the law than the mothers can't have an abortus.
Some just have sex and don't think...first take a condom or take a pill and Tha have fun...be smart.

No need to murder the child. Just put it up for adoption, or drop it off at your nearest firestation. They ought to have dropboxes like Blockbuster used to have.
