What exactly is your point? Forceable penetration is considered rape by the federal government and in almost every state in the nation. California just has different semantics for the word, but it's still considered a sexual crime. So what got your panties in a bunch to cause you to call people idiots?

Because any time a sex related crime involves white man it blows up and everything is exaggerated to make it seem worse than it actually was. You can't be convicted of intent to commit rape and rape at the same time. The crime is exaggerated and people wonder why the sentences are light when they don't even know what the crime was and what he was convicted of. 90% of the people crying about the short sentence think it was a violent rape where he penetrated her with his penis which didn't happen.

No, he just crammed his dirt-covered fingers inside her while she was unconscious. That IS violent. California penal code is very clear about the illegality of sexual penetration of an unconscious person. It's spelled out very clearly. The only difference between the charges is the specificity of the penetrant. The charge carries the same weight and penalty.

1. You don't know if it was violent and cannot assume it was. If it was violent there would have been tears or abrasions.

2. Sticking your fingers in a girl is not the same as having sex. That is known as foreplay. A few fingers is not the same as having a entire penis inside of you.

3. THe charges carry the same weight and penalty? Then why was his sentence so light? The judge always has discretion on how much time to give someone based on each individual case. There are ranges for each crime.

The judge was biased because he is affiliated with Stanford.

This is possibly the most ignorant post on this thread. Had it been a black man he would be buried under the county jail. Nice fail.

1. Tears and abrasions to her vaginal tissues were documented in the medical report, along with the presence of foreign debris.

2. Penetrating anyone who is unconscious is illegal as set forth in California penal code 289 PC. You can find everything you need to know here, where it is spelled out quite clearly.

3. Yes. This is why Persky is under scrutiny.

ITA! Poor little Brocky got a few months in jail. That's a lot less than others have gotten.

No way. It wouldn't have made the news if it was a black man! When is the last time there were protests against a black man for fingering a unconscious girl? ALL protests today are against white men. There are not protests or outrage related to black crime. Remember the duke lacross case? They were innocent and the white prosecutor had to go to prison because he broke laws to try to get them in prison. What about all the protests related to the rape that never happened from the rolling stone story controversy?! Everyone was ready to burn these innocent kids at the stake because they were white men.

And the light sentence had to do with wealth, not race. The judge even said it. You think some poor white kid would have gotten off so easy. You liberals love playing the race card any chance you get. You ever hear Latinos, Asians, or Indians playing the race card?
