Infant perhaps would not spit on somebody, on purpose at least. If the woman had aids, then what?

Exactly the point, spitting on somebody is assault - by law - for a reason.

Just touching somebody is considered assault. Unwanted non-sexual physical contact can be argued, successfully, as assault. So if you had an argument with me and you wouldn't shut up, I walk away and you grab my arm and I give you a broken nose that knocked you on the ground, you're the one that's ok for getting charged with assault? You assaulted me, and I was just defending myself, and that's ok is what you're basically saying
