No, actually a study was made of this years ago. Comparing act vs act, brutality vs brutality, whites are treated far more harshly. They tend to get charged with a more serious crime (as opposed to a less serious crime), and get harsher sentences for that higher-level crime.
If you looke at charged crime vs charged crime, the story is different, but if one examines that actual act of violence etc., the story is different.
Sure there are issues in the black community but let me get this straight. 300 years of black slavery followed a hundred years of institutionalized and government sponsored racism has magically left the black community with an equal footing in this country? I'm going to say not.
56% of those executed were White men. Who did said persons kill? Most murder victims are Black men murdered by other Black men. My point is that the #1 time a Black men gets the death penalty, the victim was often White. This means for Black victims, justice is often less.

They actually have the upper hand and are on higher footing due to affirmative action, public pressure, and fear of lawsuits.
