The President just announced that he is going to send military troops to the border. He made it sound like this has never been tried before.
Here's the truth: George Bush sent troops to the border with Mexico. So did Barack Obama. Actually so did Woodrow Wilson.
However, there are limitations to what the military can do at the border without CONGRESSIONAL approval.
The Posse Comitatus Act of 1878 prohibits the use of U.S. military forces to perform the tasks of civilian law enforcement such as arrest, apprehension, interrogation, and detention unless explicitly authorized by Congress. Basically, the act means that while a President can call for the National Guard to be activated in the case of a national emergency, he can't reassign the Navy, Army, Marines, Air Force, etc. without the approval of Congress or declaring martial law.
Congress upheld this in 2015 when Obama asked for the military to be able to do additional tasks at the border.
In both Bush's and Obama's administration, because of this, they ended up just having National Guard troops go to the border. Their role was a support role for the Border Patrol (and I might add, the Border Patrol was none too happy about it).
So, the current President will need to get approval from Congress in order to do anything different than the last two administrations. If he does not mention that, then he is uninformed. Or he will need to declare martial law, which is a whole different kettle of fish.
Anyhow, just wanted to mention this here so that people will be informed about this. Here are some articles for those who might like to read up on what has been done by past administrations, and the Posse Comitatus Act.
