It's not the same. A circuit court has a check on it. Bad decisions can be reversed. The SCOTUS does not. A fascist judge in the 10th would not be that big a deal. But in the Supreme Court? And like everything else in life, simply because one is qualified for a less responsible position does not mean one can handle the top job - witness Trump himself.
