Good question. I really hope Devos is not confirmed. After listening to her for about ten minutes I cannot stand behind her. Trump was wrong in picking her.

At the moment, Devos comes up before Sessions, so he would still be eligible to vote.

Maybe, but I doubt a resignation is automatic. I suspect he will resign right before he takes the oath of office as the US Attorney General. If necessary to get a confirmation on another nominee - he might be able to delay his Oath of Office and assumption of his new job. They will have to make sure (by salary adjustment if necessary) that the US AG does not have a higher salary than what Session made as a Senator.

There has to be some type of clause which would allow Sessions to vote, or they could delay the swearing in. I can't find anything for this particular situation, so it must be a rare thing indeed.
Two GOP Senators will vote against Betsy Devos as Education Secretary.
Assuming no other defections from either side, this means 50-50 tie.
Mike Pence will have to vote, as President of Senate to break tie.

Is He still a US Senator who can vote?
If not, then Betsy Devos will not be confirmed because it will be 49-50.
Pence can only vote if there is a tie.
Maybe Democrats wish they had already confirmed Sessions.
