It is dumb, or more to the point, dirty of the prosecutor to charge her with 1st degree murder. 1st degree is "premeditated", I see no way they can claim she premeditated the murder of those 3 idiots. IF she phoned the homeowner w/ the AR15 to tell him they were coming into the house & he should defend himself, ok, it's premeditated, but what happened, as we know it, was nothing of the sort.

The burglary was a premeditated felony. Deaths occured during the commission of the felony. That is all that is required under OK law.

Then I disagree with the law. No way should someone be charged with premeditated murder, when it wasn't premeditated murder.

Murder in the first degree doesn't have to be premeditated.

This is true in most states.

whogo is right on this. since she was in on the planing of the crime, and the crime itself, the deaths became premeditated as a result of being part of the commission of the crime.

The Daily Mail is reporting that the three burglars who were shot had robbed the same house a few hours earlier, and had come back to rob it again.

Rodriguez, faces three counts of first degree murder and burglary and is believed to have been the link to the Peters’ house, where she had dropped off an unspecified delivery of some sort.

None of this is confirmed but if true she is getting what she deserves.

Isn't there a saying about returning to the scene of the crime?

It's a longstanding legal principle; if someone gets killed when you commit a felony, you get charged for the death.

We're 11 pages into the thread and people still can't grasp this simple concept.
