Ten year olds can "consent" to violent sodomy in Austria?

The case reached the Supreme Court last year, which decided the case needs a retrial.

Why? Because the Supreme Court decided that the lower court should have ascertained, whether or not the perpetrator thought that the victim was in agreement with the sexual act. The supreme court thought that it was not sufficiently established that the perpetrator acted against the will of the victim.*The refugee was twenty years old, the boy was ten.

When the retrial took place, the Higher Court reached a verdict of seven years; way lower than the maximum of 15 years it could have given.

But yesterday, the Austrian Supreme Court ruled that even that sentence was too severe, and lowered the punishment to 4 years in prison in a final verdict.

“Four years are appropriate here,” the President of the court, Thomas Philipp, stressed in his extensive elaboration on the verdict in court. After all, the criminal offence was a “one-time occurrence.”

Personally, I find the ruling very liberal.

Any grown man that commits aggravated rape on a child should have his penis cut off and force fed to himself. After that, he can be led to the corner of a room and have a bullet introduced to the back of his head.

I don't know what their penalty for murder is, but in some European countries it's ten years. They believe they can rehabilitate their criminals, even the violent ones.

How could they say a 10-year old could consent? Was every Supreme Court justice in MAMBLA? Completely insane!

Sickening. And if theres an afterlife I hope theres a special place in hell for this migrant. And not just regular hell. I'm talking super hell, where the heat is cranked up a few extra degrees and the sadistic laughter of demons is louder and more haunting.

And what a net negative to society he is. Physically brutalizes a young boy, leaves him traumatized for life, is a tax black hole in prison, and will probably be a tax burden on welfare still after he gets out. Hows that cultural enrichment working out Europe?

I said:

What really happened? The top comment under the article assumes it was buggery, in which case the ruling is incomprehensible. But the word "rape" is applied to many things. There is no way to judge the judge without knowing the grim details.

Where would you get the idea I don't know what the term means?
