But I cannot imagine that SCOTUS would ever uphold a decision that favored sharia law over secular law. There would have to be a LOT of changes first, possibly starting with a constitutional amendment.
Anyone can argue anything in court that they wish. For instance, there are people who defend themselves by claiming they are sovereign citizens and thus not subject to a whole bunch of laws.
They get absolutely nowhere.
Except that the SCOTUS already has precedents for accepting judgments that take foreign laws and cultural traditions into account. The gourd already has a hole in it, and there are people working to enlarge that hole.
Argued as a a freedom of religion right, not to be binding if you don't want it to be which is a huge difference.
It's religious arbitration they are not the only religion that does it. In general I feel that we need to be more careful in allowing religious freedoms over human rights especially of minors, things like Female genital mutilation should be a non starter religion be damned.
Well, that "more careful" is the crux of the matter, isn't it?
It is not a religion... It is a political ideology hidden behind a veil(hijab) that has religion written on it.
In the non-assimilated communities of Muslims in the USA, Sharia is practiced, with courts established within the community.
It is a religion. The fact that some countries where the religion is prevalent are also theocracies does not make a religion "not a religion". If that were true, then during the Dark Ages Catholicism would have ceased to be a religion.
If we have to rely on the SCOTUS to rule on Sharia Law we already have a problem. It could take years for them to take on a case. We could Mufties as jurist deciding the case.
They point of the protest now are to prevent it from getting a foothold. It should be supported. IMO
Their message is :
“Sharia is incompatible with our Constitution and with American values. We stand against female genital mutilations and child marriages.”
Loony left message :
“This rally is organized by a racist hate group and is meant to generate anti-Muslim bigotry. "
Well, that "more careful" is the crux of the matter, isn't it?
right, then the problem is the act of female mutilation not sharia law. You have people on utah having underage harems, certain religions deny basic health care to minors, you want to talk about social pressures you have to look at the Orthodox Jews, Amish etc in the same vein.
I am personally opposed to all of it
