Looks like there was a conflict of interest from the defendants original lawyer, which delayed the case coming to trial. The defendant knew about the conflict and let his lawyer stay on the case. It also looks like the defendant never asked for a speedy trial, so his rights have not been violated. It's definitely a weird case, but it looks like the defendants lawyer was just really dumb. Apparently his son was going to be a witness for the prosecution, but the defense lawyer never told his client. The original judge then stepped in trying to actually protect the defendant. But then that judge retired and now the current judge is trying to decide whether a new motion to dismiss should be granted. Wow what a mess.
I would like to add that the ACLU and Disability Rights Orgs have been suing states all across this country for holding people with serious "mental illness" (which are really neurological disorders that wreak havoc on mental processes) in jails awaiting so-called competency restoration. I read that about a week at most is supposed to be within constitutional guidelines for them to be transferred for so-called "treatment" so that they can be prosecuted, and convicted. But the greatest country on earth has some of these folks jailed for up to many months on end, some cases over a year. Some have committed suicide. There are cases of people even gouging their own eyes out because of their neuro-cog consciousness disorders while held in solitary confinement, sometimes untreated.
The constitution is a crumpled document , marred with some nasty dirty footprints all over it.
Is the murder victim still dead? If so, let this fine gentleman stay in jail.
Guilty until proven innocent? Shame on you. We fought a Revolutionary war over stuff like this.
