But...murder? come on man. Thats just not reasonable and its sick to try to justify this kind of action.
I'm not justifying murder. I'm saying that, just like a case of the man who catches his wife in bed with another man, we recognize that there are additional facts and emotions that should be considered. It's classic voluntary manslaughter. No straight man can claim that they wouldn't be pissed off if this happened to them. And in the heat of the moment, anyone can do things that they otherwise would not do.
This murderer reminds me of the next-door neighbor in American Beauty.

"Rage" is not an excuse for murder and just how stupid do you have to be to complete a sex act with a man and not know it? Leave it to City Data posters to completely absolve themselves of personal responsibility.
Rage is not an excuse but it is a mitigating factor and there are thousands of legal precedents I can point you to as examples. For crying out loud, PMS has even been used as a mitigating factor and it worked!
I have no issue with transsexuals other than I feel sorry for them - it has to be a tremendous life long struggle to feel you were born into the wrong body. BUT, she should have been honest with the guy before they became intimate. Most men are not going to want to be intimate with a transsexual, that is just the reality. I'm not saying his behavior was in any way justified but, transsexuals know from personal experience that there is a lot of violence directed upon them. For her to engage in sex with this man and tell him after the fact was not only dishonest, it was stupid.
1) A good lawyer might be able to push the angle that the misrepresentation voids consent and that Mr. Stabs was raped.
2) 119 clearly shows the guy "lost it". How he reacted afterwards, remorse shown and other behaviors would impact things greatly but it's a reasonable basis for an insanity plea especially if he has an otherwise clean record. Not saying he would or should get it but it would be within consideration by the courts pending other evidence and professional evaluation.
