That only holds when that's the only factor. Officers operate on reasonable suspicion and probable cause. The officer had probable cause that he was pulling a gun.

Why because he said so? lol He didn't adhere to what I just posted.

That officer made a very bad mistake, He used poor judgement. He didn't even bother to take cover, just opened fire.

This wasn't the time to play it "safe' the officer wasn't in no mans land.

No it doesn't. The requirement is you must have every reason to believe that hehe's holding a weapon or about toto. You don't have to positively ID he has one.

He had every reason to believe he was about to pull a weapon. This video illustrates how hard cops have it.
