An 82-year-old woman is suing a Red Lobster in Texas for getting her so drunk that she fell in the parking lot, breaking both her hip and arm.

According to the suit filed in Harris County on Monday, Marlene Spencer had a 0.31 blood alcohol level when she left the seafood restaurant back in March – when she alleges the incident happened.

Of course it's management's fault that she got so drunk that she broke her bones.



And pretty please, do not mention the McDonald's hot coffee spill as a reference. That case has absolutely nothing to do at all with frivolous lawsuits.

Actually there is a part of that McDonald's story that people didn't realize. The coffee was way hotter than it suppose to be, insanely hot. The staff also knew that the machine was broken and over heating the coffee, but continued to use it. You spill your coffee while driving it usually hurts for a second than that is it. The lady I believe had to get medical treatment around her private area because of the insanely high heat of the coffee. Maybe some people will still side with McDonalds, but this changed my mind of the issue.

really? the management of red lobster forced her to imbibe to the point where she was three times the legal limit. so apparently she has no responsibility for controlling her alcohol intake? i wonder what would have happened if the restaurant cut her off after a couple of drinks, would she then sue the restaurant for not serving her?

as fro the mcdonalds case, once again the woman in question has no responsibility for her actions? remember she left the driver through, and put the coffee between her legs, pulled off the top, while driving, to put in the cream and sugar she wanted. she didnt pull off into the parking lot to do this, she did it on the road.

i am sorry but these people deserve nothing because their own actions contributed to the problems they now face.

Some cliffs are really taller than other cliffs, some snow are more slipping on certain areas, some clothing sizes are different even though they are the same size, some coffee are going to be hotter than other coffee... someone is going to be an idiot and fall off that really tall cliff, should they sue the government? The plantiff won because they got a jury that was dumber than she was...

Actually, when I was a bartender, it was drilled in to our heads that if we were the cause of someone drinking so many drinks and they got in to an accident later, we were liable. Bartenders do have a responsibility to cut people off when they see the person getting intoxicated. That's not a new rule.

My God, how stupid. But I bet RL settles to avoid a court case, cheaper that way. Seems odd, but that is generally how chains work.

The media totally embellished that story. The lady had the right to sue in that case. She only asked for her medical bills to be paid, $20,000, but McDonald's wanted to be asshats:
