well then more reasons for the guy to sue.

You don't claim the guy to be racially insensitive if he wasn't. That is just messed up!

No law suit will tell me this guy knew what he was doing. It is just screaming for a law suit otherwise.

Not everyone believes in lawsuits so it wouldn't really inform us of anything for sure.
