I'm seeing the headlines now. Conservative airline employee burns liberal customer or it could be reversed with same result.

Doubtful. Her Lawyers assumptions don't sound correct (she would have to prove the FA was not following procedure). Hot drinks are either placed down towards the seat in front of them are if too far are passed to the passenger on a tray one at a time. Her burn being on her upper thigh towards her chest (not including her chest) suggests she may have knocked it over herself as there was no burn towards her knee(s). Also attendants offer drinks as a general term and customer 'request' precise items and pay ($1.99) for certain drinks.
