Bliss v. Commonwealth - 1822
A Kentucky man was indicted for carrying a sword concealed in a cane. He was convicted and fined $100.
Lower courts ruled concealed swords, were not unconstitutional to carry and use for defense of person or property.



The first Supreme Court challenge to the 2nd Amendment, came after the Civil War(of course! The only time the full exercise of the Amendment was put to use)

92 U.S. 542 (1876) was the first case in which they heard on the Second Amendment. States restricting the right to keep & bear(later heard over Militia) The intent to keep blacks from arming themselves and creating a Militia.

The Court recognized that the right of the people to keep and bear arms was a right which existed prior to the Constitution when it stated that such a right “is not a right granted by the Constitution . . .

The Court held, however, that because the right to keep and bear arms existed independent of the Constitution, and the Second Amendment guaranteed only that the right shall not be infringed by Congress, the federal government had no power to punish a violation of the right by a private individual; rather, citizens had “to look for their protection against any violation by their fellow-citizens” of their right to keep and bear arms to the police power of the state.


The Court declared that the Constitution does not grant the right to bear arms; what it does say is that the federal government will not interfere with that right.
This was the law until just 7 years ago.....

McDonald v. Chicago.



For not being able to infringe, that have done a lot of infringing.


Militia is illegal, as the police state has suppressed the free state, the privilege of citizens that are non-felons and mentally sane, may keep but not bear the small arms the government allows, this may change at anytime.

You have seen this...


There seems to be a majority here that feels the 2nd amendment only covers guns/small arms, when it doesn't. Until amendments are made, it covers all arms. Even nuclear arms.

This is hard.

I agree with Bentbow.

arms is not specifically fire arms. As such many limitations should not be there. Including nuclear weapons. If we dont like that we should pass a amendment, not do the runarounds we currently do.

Why didn't they write, to keep & bear weaponry?
They were not running out of ink on the 2nd amendment, they could have been as specific and controlling as they wanted to be on the limitations of the 2nd Amendment. Why were they not specific?
Because people in the USA, have liberties among rights. It not being limiting, meant you as an individual have the choice all on your own, what to arm yourself with and feel well regulated enough in its use to be efficient.

Well, I don't have the facilities or know how to keep and maintain an ICBM?MRV. Maintenance Is a daily chore for any nuke. They are persnickety critters. I can maintain my small arms and enjoy them when I please. I've cred on 19th century civil war cannon before but I'm not going to fork the bucks up for one.


They're fun though. Did live fire with a 6 pound ordnance rifle and a Whitworh. I brought a bunch of 40mm slugs that were piled up in the de mil scrap. They fit like a glove. We were nailing 50 ga drums at 600 yards.

Concerning the right to bear arms; it should always should come down to what works for a person & what they can use effectively; and Not What a Person Needs.


No one should ever have to defend a purchase; I have the money for something; it was not illegal, and I wanted to buy what ever item it is. Whether I paid too much for a item, or I bought a really cheep product, they only person I would need to explain any purchase to is my spouse. No one should ever indicate to you do need that item; and their for can not buy it.
