The problem with banning hate speech is the powers-that-be define what constitutes hate speech.

The potential for abuse should be obvious.

Cite and describe the 1919 Supreme Court case, please.

And then reconcile that (alleged) case with the Supreme Court's later decision to allow uniformed Nazis to march in Skokie, IL, a heavily Jewish community, after WW II.

As far as I know, a U.S. citizen -- not a foreign terrorist, or a U.S. citizen conspiring with foreign terrorists such as ISIS -- can say anything he wants, including calling for the extermination of any group he doesn't like.

The only thing he can't do is incite a mob to commit violence right then and there.

But even then, the mob has to actually commit the violence right then and there for a case to be made against him.
