Collusion can be a crime in numerous instances. When people make that stupid statement, they are specifically talking about when Trump colluded with the Russians to swing the election in his favor. Typically when you are colluding with someone, you're colluding to do something illegal as well. There's little point to colluding if what you're planning is on the up and up.
But this is a civil suit, that can result in Cohen and Davidson being disbarred, and as Greywar mentioned earlier, could lead to the Stormy NDA being voided.
