When Heller says, "if weapons that are most useful in military service—M-16 rifles and the like—may be banned," what makes those weapons "bannable" under NFA-34?
Well, it isn't pistol grips or flash hiders or barrel shrouds or collapsible stocks . . . It is the fact that M-16's have an auto-sear that allows the firearm to fire more than one bullet with a single trigger pull. Weapons that are "like" M-16's will also have an auto-sear -- OTHERWISE THEY ARE IMMUNE FROM ANY NFA-34 REQUIREMENTS.
Actually, under the law, EVERYTHING that the 4th says makes AR-15's "like" an M-16 are of zero consequence. The auto-sear and trigger parts (fire control group) is the transferable Title II item; the rest of the parts and furniture that make them LOOK similar, are not.
"26 U.S.C. 5845(b) defines “machine gun” to include any combination of parts designed and intended for use in converting a weapon to shoot automatically more than one shot,
without manual reloading, by a single function of the trigger."
Don't kid yourself, this stupidity won't stand and AR's and all other semi-auto, detachable magizine military LOOK-ALIKES, will be held to be protected by the 2nd Amendment.
