I was told by a man with a concealed carry permit that part of his classroom training involved laws and liability. He was told to shoot to kill so the criminal couldn't contradict his story of self-defense. Dead men tell no tales.

You are asking the wrong question. The underlying question in all this comments are: How can I make MY house safer. Following old barbaric tradition they answer, buy a gun and shoot whoever dares to come in.

Look at very safe places like japan. You could probably drop a wallet full of money and come back hours later and find your wallet or if somebody saw it turned it to the police, etc. almost certain. They do not ask how can I make my house safe, but how can we make OUR community safer.

In latin america where robbery is rampant, the police will sometimes turn a blind eye and let people take justice into their own hands just because it is easier than dealing with so many cases, but as a general rule the life of thieves are protected. This protection is more prevalent in countries which do not let the u.s. boss them around to rev up the war on drug which always has the consequence of more crimes, violence and deaths.

If the police has enough evidence they would have gone to the Crown Prosecution Service (CPS) already and he wuld have been charged, insteas the man has been released on bail. In circumstances other than terrorism, the police in England & Wales can hold you for up to 24 hours before they have to charge you with a crime or release you, and the decision is down to the CPS and not the police.

A senior police officer of Chief Inspector or above can sanction a further 12 hour extension bringing detention time up to 36 hours befire either charging or releasing a person, and in very serious crime such as murder or rape they can apply to a magistrate to increase detention to a maximum of 96 hours. The laws are however very different in terms of terrorism, where you can be detained and quesyioned for 14 days without charge.

Richard Osborn-Brooks the man in question was released on bail the same day pending further inquires, which indicates that the police don't have enough evidence to charge him and, and that the CPS will most likely throw the case out.

The Bail Laws changed last year, and he can only be kept on bail for 28 days, after which only a senior police officer of Superintendent or above can authorise further bail in relation to certain comples cases, this can not exceed three months. During this time the police need to put a full report in to the Crown Prosecution Service lawyers who will decide whether there is enough evidence or if it's even in the public interest to prosecute.

So many Americans have enough trouble understanding our own laws, most should really just stay mute on foreign laws until the results are in.

It is interesting to post the story for information or debate, but to comment on what is right or wrong about the law being enforced is non-productive and pointless.

The kung full instructor makes a good point - you should be able to defend your home, not just your self - homes are "safe spaces"

I agree and most people in the UK would agree.

I don't know all the circumstances, but as far as I can see there was no need to arrest this man, or further arrest him on suspicion of murder. The British Press is ging up the wall, and we all know he won't be found guilty of anything.

I remember the case of Detective Constable John Fordham, who was an undercover surveillance officer with the Metropolitan Police. He was stabbed to death whilst on duty, he was wearing a balaclava and camouflage. and in the grounds of well known Criminal Kenneth Noye. Noye's dogs started barking and Noye went on got a kitchen knife, before coming across the police officer who he promptly stabbed to death.

The Jury found Noye not guilty and that he had acted in self defence, as any reasonable person finding someone wearing a balaclava and camouflage in their garden at night might well do the same.

Noye did go on to kill again in relation to a road rage incident, but was aquitted of the murder of the police officer on grounds of self defence.

This makes you wonder why the police are being so stupid in relation to this case, as there is not a hope in hell of this man being found guilty of anything.

Good News - he shouldn't have been arrested once for GBH and then for suspicion of murder in the first place.
