NYPD Chief of Department Terence Monahan said that four officers -- three in plain clothes, one in a department uniform -- responding to three calls about a possibly armed man in Crown Heights found him at Utica Avenue and Montgomery Street about 4:45 p.m.
Monahan said the man "took a two-handed shooting stance and pointed at the officers," who in return fired a total of 10 shots.
The questions:
"Does someone have to be injured (or killed) prior to the suspect being shot (use of deadly force)?"
"Can a policeman shoot to preserve life?"
"If, with only the knowledge in that moment, someone is shot who does not have a weapon, what is the legal burden upon the policeman?"
In this case, the suspect was using an object to simulate having a gun. Does that make a difference?
when the object is pointed at the cops, they shoot. When the object is pointed at a citizen, the cops hide behind the nearest object.

So yes, I agree that the shooting was justified. Three 911 calls about a man pointing a gun at passersby and the man holding an object that looked like a gun and who was gesturing with it like it was a gun.
Are people really this stupid? Oh yeah they are. If a cop is pointing his gun at you they are doing so because they are worried that you are going to hurt them or someone else. If they are screaming at you to get down or put up your hands or to do a little dance you do it.
The amount of people that do not follow their orders in a highly charged moment and then get shot as a result is ridiculous.
If the cops are in the wrong the matter will be resolved. You might get an apology, you might even get a settlement but you will certainly live to see another day.
I'm sorry the man died. But if I'm a cop in a dark city street, and a suspect points something at me (a pipe, at night, might resemble a rifle), I'm probably going to shoot. And they were already responding to reports of an armed man, so they arrived knowing he might a weapon. And then upon arrival, he points something at them?
The old saying is cliché, but I'd rather be judged by 12 than be carried by 6.
