I guess I missed this. There were huge headlines months ago President Trump was required to extend an illegal DACA program. Now last months, another Federal court said the opposite... and there wasn't much attention from the leftist media.

One of the most noteworthy things about this decision was that, though the Federal judge personally didn't like to see DACA wound down, he nonetheless had the integrity and professionalism to decide the case on Constitutional terms rather than legislating from the bench as the courts judge-shopped by the leftists keep doing.

Federal Judge Roger W. Titus ruled yesterday in the Federal District Court of Maryland that the Trump Administration’s decision to rescind the Obama-era DACA program is legal. The judge's decision could help the Administration appeal New York and California court rulings requiring the continued processing DACA-status renewals.

"This decision took control of a pell-mell situation and provided Congress — the branch of government charged with determining immigration policy — an opportunity to remedy it. Given the reasonable belief that DACA was unlawful, the decision to wind down DACA in an orderly manner was rational," Judge Titus wrote.

Despite the opposition's argument that the "inappropriate" nature of Pres. Trump's tweets should be considered in the court’s final ruling, Judge Titus stated that the the President's decision to rescind the illegal DACA program was "rationally supported," and that the his tweets were irrelevant to the court’s injunction to repeal it.

Judge Titus commented that, despite his personal dislike for the outcome of the ruling, the court is “constrained by its constitutionally limited role,” and urged Pres. Trump and Congress come into agreement on a solution.

It is ridiculous how this mess has dragged on and on. Trump has tried to do something but the Left just wants to kick the can down the road no doubt until thye regain the WH and can then push for amnesty.

Here is the problem: Judge Titus (a Federal District Court judge) was not the final word on the matter. It was one decision of several.


The problem as I see it in a nutshell: a Federal district court in California had issued an injunction (I believe it was) allowing DACA to continue. The Justice Department filed an emergency appeal with the US Supreme Court. On February 26, 2018, the Court declined to hear the appeal, simply saying:


"It is assumed the court of appeals will act expeditiously to decide this case."


Until the US Supreme Court hears the case, I believe that DACA protection continues. That a new Federal District Judge subsequently ruled otherwise (i.e., to end DACA) is moot.


It is why the DACA issue has been put on the 'back burner', so to speak. The Trump Administration has been accepting renewals of DACA protection.

Please. The left is not kicking this can. Theyve even offered money for his wall for it, and Trump refused. He just wants more for his hostages.

Trump can fix this anytime he wants. He is just holding them hostage.

Uh no, Trump offered DACA but left wanted to expand it for millions, Trump refused.

What a novel concept, a judge with the integrity to be guided by this principle. Too bad there aren’t more that heed this - regardless of the topic or position they are ruling on. The judicial branch was never meant to legislate, no matter how popular or unpopular a cause.

The Democrats also wouldn't give him but a mere pittance of the cost of the wall and they didn't want the visa lottery and chain migration to end. So no wonder Trump refused. Ultimately, the original deal never went through. I guess DACA wasn't all that important to the Democrats after all.
