Was your photo an image you posted online? Or a photo of you taken in a public space? Not much you can do about either.
This was someone employed by a company who violated the rules of that company. Most, if not all, day care centers have such a policy.
Jimmy Kimmel took the video from an online source where it had already been made public. No violation on his part - they didn't know what the circumstances were, more than likely.
But for this family to get money out of it, they have to prove damage.
It is that simple.
